IANA Constitutional L but, what I’m guessing will happen is that they’ll come up with a tortured “originalist” interpretation of the phrase “subject to the jurisdiction [of the United States]” that somehow relies heavily on the hottest of hot takes from some theologian from 1610 or so, while ignoring any actual relevant common law, legal theory, or case precedents from US history that contradict their position.
Alito and Thomas will do that, for sure. I think Barrett will again side with the three liberal women. So it’ll come down to Roberts, Gorsuch, and Kavanaugh. I have a hard time seeing all three of them buying the bizarro interpretation, but who knows?
The tortured interpretation, by the way, will be that the sole intent of this clause of the 14th Amendment was to undo the Dred Scott decision and grant citizenship to all formerly enslaved people and their descendants.

Eventually, we will need 5. We know Alito and Thomas will go with whatever Il Duche wants, Barrett is probably the most likely to side with Rule of Law. That would do it. I can only hope for the other 2 to come to the light.
The problem will be when Trump just ignores SCOTUS. At that point, Roberts will probably regret granting Trump broad immunity from criminal prosecution. Because ultimately, SCOTUS has no ability to enforce its orders. There’s no Judge Dredd in the real world.

Trump has also long wanted defamation law weakened, so this is another sign that SCOTUS isn’t going to just automatically support Trump on everything. Although, if Trump weren’t President, I don’t think that would even be a story. Wynn just didn’t have a case.
So there was a not-entirely-insane SCOTUS ruling on ghost guns, and it was a 7-2 decision written by Gorsuch, of all people. I guess I’ll take that as a minor win, for once.
