This keeps happening, too… there is a ruling that goes against what Trump wants to do, then some higher court allows them to keep doing the bad thing, despite the damage it will cause… I wonder, @danimagoo, how much this has to do with the SCOTUS decision about official acts? Honestly, this is just the normal process. It sucks because everything is moving so fast, and the system isn’t really designed to cope with that. And the media doesn’t help when they don’t report court decisions or orders accurately, which they almost never do.
For this case, no court has issued a ruling on the merits of the case yet. The district court issued a temporary restraining order, which they will do when (a) they think it’s likely the nonmoving party will lose on the merits and (b) allowing the law/action/whatever to remain in place until a ruling on the merits will cause damage to the moving party. So that’s what the district court found here. But the party that’s bound by the TRO has a right to appeal that order, which the Trump administration has done. And when that happens, the appellate court will stay the TRO until they hear arguments on the TRO. Again, that appeal, when they hear arguments (which I think is Monday?) won’t be about the merits of the case, but only on the appropriateness of the TRO. So the merits of the case will come up, but the appeals court won’t rule on that, only on the TRO. But all this back and fourth – a district court blocking Trump, an appeals court staying that block, then the appeals court reinstating it, and so on and so on – is all very normal and part of the process of the federal courts. Unfortunately, every step of the way, the media reports this shit as “Trump loses in court!” and “Appeals court sides with Trump!” when none of that is what’s happening. The sausage is in the process of getting made, and the media is telling everyone the sausage is done.
This. For the most part, “farmers” in the US means “big agribusiness.” Even when actual farmers own their land, they are entirely dependent on mega corporations and are up to their ears in debt. And on top of that, the land was stolen.
Many Black farming communities and families have less debt, due to racist lending practices. If they’re able to sell locally and avoid Big Agribusiness, they’re in a better position to keep their land.
