The Fake “Play the Ref” News, in order to create a divide between me and our great U.S. Supreme Court, heard me say last night, loudly and openly as I was walking past the Justices on the way to the podium, “thank you,” to Chief Justice John Roberts. Like most people, I don’t watch Fake News CNN or MSDNC, but I understand they are going “crazy” asking what is it that I was thanking Justice Roberts for? They never called my office to ask, of course, but if they had I would have told these sleazebag “journalists” that I thanked him for SWEARING ME IN ON INAUGURATION DAY, AND DOING A REALLY GOOD JOB IN SO DOING! The Fake News never quits!
Alito is stunned the USSC won’t let his mad king do whatever the fuck he wants.
Alito is so full of shit he doesn’t need bribes; he can just sell it to farmers and be richer than Musk.
The very, very first principle of this case is: the contractors legally spent the funds in accordance with the terms of the contract. Legally, (and per the 14th Amendment), the government is obligated to pay these expenses.
Second, and Alito well knows, is that there is a procedure for recovering misspent funds, which is aggressively exercised by the government. He is being disingenuous in saying the government won’t be able to recover the funds, first because a mechanism exists (and has been litigated over and over in front of the Court) and because any clawback would not apply to the full amount to be paid.
Next, his claim of sovereign immunity is absolute bullshit. This is the government acting in its contractual capacity, not its sovereign capacity. The government “hired” these organizations to do a job. They did the work they were hired to do. They therefore must be paid for their good-faith execution of the contract. No one is questioning whether the government has a right to terminate the contracts (they are disputing whether it was done in accordance with law, regulation, and in good-faith), so sovereign immunity has nothing to do with it. This is some weird-ass sovereign citizen bullshit.
Finally, Alito’s complaint that both the ruling was too broad and could have been handled in administrative court is too precious for words. He knows damn well that the administrative courts would be overwhelmed with cases, would take years to litigate, at which point most of the plaintiffs would be bankrupt and these suits therefore moot. Many already are.1 The only relief available that would not result in irreparable harm to the current and future plaintiffs is a nation-wide injunction.
That Gorsuch and Beerboi went along with this is concerning, as this is a slam dunk, but the law prevailed on this, dispite Alito literally making shit up to provide cover to King Lear.
1 Many have already gone bankrupt. Far too many. Most NGOs, non-profits by definition, are not sitting on piles of cash to absorb costs while this gets litigated, and most are primarily USG contractors, so when those funds run out, the organizations shutter.
This is, of course, what Project 2025 wants, as civil society organizations help hold governments, foreign and domestic, accountable. And we all know how much “conservatives” like accountability.
