Yeah, I was just catching up on this thread, and was going to reply to your other post about that case and point out that Kacsmaryk’s decision is in direct conflict with Bostock. District courts DO NOT have the discretion to overturn SCOTUS decisions. Our entire common law judicial system operates on the principle of stare decisis. This means that all courts below another court have to follow the precedent set by the higher court. No district court has any other court under it, so they are only free to make their own new decisions on issues that have never been litigated. When an appeals court makes a decision, every district court in that circuit has to follow their decision. So if the Appeals Court for the Fifth Circuit issues a decision on a novel issue, Kacsmaryk has to follow it. SCOTUS, of course, is the final court of appeals. Every federal court has to follow their decisions. All appeals courts, all district courts, all of them. Now, SCOTUS never has to follow their own precedent. They can always change their mind and overturn an earlier ruling. And while this is often infuriating (Dobbs for example), it’s also necessary. Without that ability, segregation would still be legal. Anyway, the bottom line is that Kacsmaryk is not supposed to have the discretion to ignore Bostock, but he did here. The Fifth Circuit should overturn his decision and sanction him. They won’t sanction him. They really should because this isn’t the first time he’s ignored precedent. Hopefully they’ll at least overturn his decision, but the Fifth Circuit is pretty conservative, so who knows? Unfortunately, this will give SCOTUS an opportunity to revisit Bostock, if they want. Such bullshit.
