The bill also allows Arkansas parents to sue people or medical providers outside of the state who help Arkansas youth access gender-affirming care.
I would anticipate this would be chilling on providers offering to help these kids. Not at all sure this would stand up in court, but I am guessing someone is going to try.
But also, have we really entered an era of state-approved haircuts for God’s sake?

There is no way to enforce such a judgment. So this law sets civil penalties. In other words, it allows someone to sue someone else who is providing gender affirming care. So, in civil lawsuits, when the two parties are from different states, you have to sue in federal district court. The reason for this is that, for example, Arkansas state courts have no jurisdiction over residents of California. However, then you have to figure out which federal court to sue in. In this case, you’d have to sue in California, because, again, the federal courts in Arkansas have no jurisdiction over residents of California. But, when you sue over state claims in federal court, the court has to follow the law of the state in which the court resides. In other words, you sue in federal court in California, the court follows California state law. And in this case, California has no such law. So no lawsuit. The only way you could sue someone from another state using this law is if that person is advertising their services directly to people in Arkansas. In other words, if a California gender clinic ran ads on local Arkansas television stations, then that would give that clinic enough contact with the state of Arkansas to be subject to its courts’ jurisdiction.
Figured as much, but intimidation is every bit as much of a goal for this kinda shit as actual enforcement. And most doctors are raised with a deep fear and distrust of the courts, and will go to great lengths to avoid them. It certainly could result in providers refusing out-of-state patients, just on the threat. Although I have to say, the folks I know who provide gender care are some of the ballsiest, most defiant docs I have run across. So there is also the “Yeah, you and what army” attitude that could come up. I don’t know, I hate this shit deeply.

By making their statement they’ve proved themselves to be anti-woke (aka, absolute shitheads) and can blame “activist judges” for getting in the way.
