Statement from Trans Iceland regarding the deportation of a trans woman to the United States:
"The board of Trans Iceland strongly criticizes the decision of the Icelandic Immigration Service to deny an American trans woman and her son international protection and to deport them back to the United States. The mother arrived in the country just over a week ago due to the worsening situation of trans people in the West due to the crackdown on their rights, but as Trans Iceland and Samtökin â78 have repeatedly pointed out, since Trump took office last January, trans people have had to endure, to say the least, gross persecution by the government. The US government has systematically undermined the acquired rights of trans people, as numerous examples show and organizations such as Human Rights Watch have discussed. The freedom of travel of American trans people has been abolished thanks to new passport and border control rules, while their rights within the country have been restricted.
The Ministry of Foreign Affairs recently issued travel guidelines for queer people in response to these developments. The Minister of Foreign Affairs has also spoken publicly about the global backlash and the importance of Iceland using its voice to defend human rights. It is therefore wrong that the Icelandic government, through the Icelandic Immigration Service, should in this way refuse to face the reality that trans people currently live in the United States. The womanâs application for international protection was deemed âmanifestly unfoundedâ despite reasoning and evidence that showed otherwise. To add insult to injury, she was then referred to the US embassy when she was deprived of services after a negative outcome was received in her case. This practice is truly incomprehensible and indefensible when it comes to an individual who belongs to a group that is subject to similar attacks by the US state as trans people. The decision to deport also includes a re-entry ban in Iceland and other Schengen countries for at least two years, and the Icelandic government has thereby further limited her ability to leave the unsafe situation she has had to endure and will face on the West Coast.
As has been pointed out, it has long been clear that the United States does not belong on the list of safe countries of origin when it comes to individuals living in marginalization, such as trans people. We strongly urge the Minister of Justice and the Minister of Foreign Affairs to work to ensure that trans people in exile are received, wherever they come from. The current list of âsafeâ countries simply does not cover the reality of trans people. If Iceland wants to continue to uphold the values ââof human rights and equality in the serious setback we are witnessing internationally, then burying our heads in the sand is not enough."
