I wish I were surprised. I’m not. Our last decent governor was Jay Nixon, and he wasn’t that great. Neither Kehoe nor his predecessor, Mike Parson, graduated college, and Parson’s predecessor resigned in a sex scandal.

This makes no sense to me. It was an emergency TRO. If the district court judge found cause for the TRO, the appeals court shouldn’t be staying the TRO. That defeats the whole purpose. If it’s an emergency to get the National Guard out of LA, then it’s still an emergency. It’s not an emergency to keep them in LA, that is easily provable. :face_with_symbols_over_mouth:

It’s just how these things work. If a district court issues a TRO, and the restrained party appeals, the appeals court will stay the TRO until they hear arguments. This isn’t unusual. It’s just the process.

They shouldn’t issue the stay if it’s in the middle of the night. Especially for something like this, where lives are at stake. If they don’t have time to hear it, they shouldn’t stay it.

This is like issuing a stay on a personal TRO when an abusive ex is outside the courtroom with a gun. Judges are supposed to show judgement.

I hear you, but this is just how this process works. Shit is moving really fast right now, and our judicial system is not designed to deal with that, unfortunately. When an appeal to a TRO is made, a stay is basically automatic. I don’t think they had the option to not issue the stay.

Let’s put it this way: if the situation was reversed, they wouldn’t have issued the stay. That’s happened again and again.

Courts have been doing a pretty good job against T****’s authoritarian bullshit, and you’re right that they aren’t really built for it and doing their best. But they do have discretion and too often aren’t using it.
